1. INTRODUCTION

Welcome to the Blutter App Community!

These Community Guidelines ("Guidelines") establish the standards of behavior, content, and interaction expected from all Users and Creators on website and/ or mobile application (the “Platform” or “Blutter App”) operated by Efficacy Techlabs Private Limited ("Company," "We," "Us," "Our"). Our goal is to create a safe, respectful, and enjoyable environment where Creators and Users can connect meaningfully.

These Guidelines are integral part of Terms of Use, Refund Policy and Privacy Policy of Blutter App (collectively, the “Platform Policies”). By accessing, browsing, or using the Platform and agreeing to the Platform Policies while signing up amounts to acceptance under the Indian Contract Act so as to constitute a valid contract. By signing up, accessing, browsing or using the Platform, you acknowledge that you have read and understood the Platform Policies and bound by them. If you do not agree to these Terms, please do not access or use the Platform.

Violations of Guidelines may result in content removal, account suspension, or permanent ban. Where the violation relates to the commission of any offence under any law for the time being in force, such as IPC / BNS or POCSO which requires such offence to be mandatorily reported, Company shall be required to report such offence to the appropriate authority.

g) Privacy - Respect the privacy and boundaries of others

h) Legality - Comply with all applicable laws and regulations

3. WHO THESE GUIDELINES APPLY TO

3.1. Creators

Creators have a heightened responsibility as public figures on the Platform. You are expected to:

• Lead by example in following these Guidelines
• Create content that complies with all policies
• Interact professionally with Subscribers
• Not exploit your influence to harm others
• Report violations by Subscribers

3.2. Users

Users are expected to:

• Engage respectfully with Creators and other Users
• Not harass, stalk, or abuse Creators
• Respect Creator boundaries and content restrictions
• Not redistribute or misuse Creator content
• Report violations by Creators or other users

3.3. Community (Users and Creators)

Everyone on the Platform must:

• Follow these Guidelines at all times
• Comply with Indian laws and regulations
• Use the Platform only for its intended purposes
• Not engage in any prohibited activities
• Cooperate with Platform investigations

4. CONTENT POLICY

Permitted Content - Subject to standards and limitations set out in these Guidelines, the following types of content are welcome on the Platform :

4.1.Content Standards

All content must meet these standards:

a) Originality - Content must be original or properly licensed and credited

b) Accuracy - Claims and statements should be truthful and not misleading

c) Quality - Content should meet basic quality standards (clarity, coherence)

d) Relevance - Content should be relevant to the Creator's profile and audience

e) Compliance - Content must comply with all applicable laws and shall not be violating of any law for the time being in force 

5. PROHIBITED CONTENT AND ACTIONS

The following content and actions are strictly prohibited on the Platform. Posting such content will result in immediate removal and may lead to account termination and other legal action(s).

5.1.Sexual and Adult Content

a) Pornography - Explicit sexual acts, intercourse, or graphic sexual content

b) Nudity - Full or partial nudity including genitals, buttocks, female nipples

c) Sexual Solicitation - Offering or requesting sexual services

d) Sexual Exploitation - Content exploiting individuals sexually

e) Obscene Material - Content that is obscene

f) Paedophilic Content or Sexually Suggestive Content Involving Minors - Any sexual or suggestive content depicting or involving persons under 18

Note: Blutter App is NOT an adult content platform. We maintain a strict policy against any form of sexual or pornographic content.

5.2. Child Safety Violations

We have ZERO TOLERANCE for child exploitation. All such content will be immediately removed, reported to NCRB (National Crime record Bureau), Indian Cyber Crime authorities, and relevant law enforcement authorities. Violators will be permanently banned and prosecuted.

The following content shall be deemed to be violating :

a) Child Sexual Abuse Material (CSAM)-Any sexual content involving minors

b) Child Exploitation - Content that exploits, abuses, or endangers children

c) Grooming - Content or behavior aimed at befriending minors for exploitation

d) Inappropriate Content Involving Minors - Any content that sexualizes, objectifies, or endangers minors

e) Sharing Minor's Personal Information - Doxxing or exposing personal details of minors

5.3. Violence and Dangerous Content

a) Graphic Violence - Content depicting real-world violence, gore, mutilation, or death

b) Threats of Violence - Direct or implied threats to harm individuals or groups

c) Incitement to Crime or Violence - Content encouraging or inciting others to commit violence or any cognizable offence; or prevent investigation of any offence,

d) Glorification of Violence - Praising or celebrating violent acts or perpetrators

e) Dangerous Activities - Content promoting dangerous challenges, self-harm, or risky behavior

f) Animal Cruelty - Content depicting abuse, torture, or killing of animals

g) Terrorism - Content promoting, glorifying, or supporting terrorist organizations or acts

h) Weapons - Content promoting illegal weapons, explosives, or instructions to harm

i) Threat to Nation – threatens the unity, integrity, defence, security otr sovereignty of India, friendly relations with foreign states, or public order, or is insulting to any other nation ;

5.4. Hate Speech and Discrimination

a) Hate Speech - Content insulting, harassing or attacking individuals or groups based on protected characteristics

b) Discrimination - Content promoting discrimination or exclusion

Slurs and Derogatory Language - Use of slurs targeting any group

d)  Dehumanization - Content comparing groups to animals, diseases, or subhuman entities

e)  Enemity – Promoting enemity between different groups on the grounds of religion or caste with intent to incite violenc)ce

f) Supremacist Ideology - Content promoting racial, religious, caste, or ethnic supremacy

g) Holocaust/Genocide Denial - Denying or minimizing documented atrocities

Protected Characteristics Include:

• Serious medical conditions

5.5. Harassment and Bullying

a) Targeted Harassment - Repeated unwanted contact, messages, or attention directed at an individual

b) Bullying - Content intended to degrade, humiliate, or intimidate

c) Cyberstalking - Persistent monitoring, tracking, or following online

d) Dogpiling - Coordinating attacks against an individual

e) Revenge Content - Sharing intimate images or private information to harm someone

f) Sexual Harassment - Unwanted sexual advances, comments, or requests

g) Threats - Threatening harm to an individual or their loved ones

h) Doxxing - Sharing private personal information (address, phone, workplace)

i) Intimidation - Behavior intended to frighten or coerce

j)  Invasive – invasive of another’s privacy, including bodily privacy

5.6. Misinformation and Deception

a) Mis-information – Communication of any information which is patently false or untrue or misleading in nature, and include specifically :

-Government Mis-information - In respect of any business of the Central Government, is identified as fake or false or misleading ;

-Health Mis-Information - False medical claims, fake cures, anti-vaccine disinformation

-Election Misinformation - False information about voting, candidates, or election processes

-Dangerous Misinformation - False information that could lead to physical harm

b) Manipulated Media - Deepfakes or edited media presented as authentic to deceive

c) Conspiracy Theories - Demonstrably false theories that could cause harm

d) Impersonation - Pretending to be someone else to deceive

e) Fake Credentials - Falsely claiming qualifications, certifications, or affiliations

f) Scams and Fraud - Content promoting fraudulent schemes

g) Deceiving – Deceives or misleads the addressee about the origin of the message

5.7. Illegal Activities

a) Drug Content - Promoting, selling, or instructing on illegal drug use or manufacture

b) Illegal Weapons - Promoting or selling illegal firearms, explosives, or weapons

c) Human Trafficking - Any content related to trafficking or exploitation of humans

d) Prostitution/Escort Services - Offering or soliciting paid sexual services

e) Money Laundering - Content relating to, encouraging or facilitating money laundering or financial crimes

f) Fraud and Scams - Phishing, pyramid schemes, fake investment schemes

g) Hacking and Cybercrime - Promoting or instructing on hacking, malware, or cybercrime

h) Piracy - Sharing or promoting pirated content

i) Gambling  – relating to, encouraging or Promoting illegal gambling or betting services

j) Counterfeit Goods - Selling or promoting counterfeit products

5.8. Intellectual Property Violations

a) Copyright Infringement - Using copyrighted content of which you do not have permission

b) Trademark Violations - Unauthorized use of trademarks or brand identities of which you do not have permission / license

c) Content Theft - Reposting others' content as your own

d) Piracy Promotion - Sharing links to or promoting pirated content

5.9. Spam and Manipulation

a) Spam - Repetitive, unsolicited, or irrelevant content

b) Engagement Manipulation - Fake likes, followers, comments, or views

c) Bot Activity - Using bot, scrapers or automated tools to interact with the Platform

d) Clickbait - Misleading titles or thumbnails to drive engagement

e) Coordinated Inauthentic Behavior - Fake accounts working together to manipulate

f) Platform Manipulation - Exploiting Platform features for unintended purposes or Attempt to hack, reverse engineer, or compromise the Platform

g) Virus – contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource

5.10. Privacy Violations

a) Sharing Private Information - Posting someone's personal data without consent

b) Non-Consensual Intimate Images - Sharing intimate photos/videos without consent

c) Recording Without Consent - recording conversations made without the subject's knowledge

d) Stalking Content - Content that enables or encourages stalking

e) Breach of Confidentiality - Sharing confidential conversations or information

f)  Un-authorised Promotion – is in the nature of advertisement or surrogate advertisement or promotion of an online game that is not a permissible online game, or of any online intermediary offering such an online game

6. HARASSMENT POLICY

6.1.Our Commitment

Company has ZERO TOLERANCE for harassment. We are committed to maintaining a safe environment where all users can interact without fear of harassment, abuse, or intimidation.

6.2.What Constitutes Harassment

a)  Verbal Harassment- Insults, name-calling, degrading comments, slurs

b) Sexual Harassment - Unwanted sexual comments, advances, requests for sexual content

c) Threats - Threats of violence, harm, doxxing, or other negative consequences

d) Stalking - Repeatedly contacting someone who has asked to be left alone

e) Intimidation - Behavior designed to frighten or coerce

f) Bullying - Repeated harmful behavior targeting an individual

g) Pile-ons - Coordinated attacks by multiple users

h) Doxxing - Sharing private information to enable harassment

i) Impersonation - Creating fake accounts to harass or defame

j) Revenge Actions - Sharing intimate content or private information to harm

6.3.Harassment Across Platforms

We may take action for harassment that:

• Occurs on our Platform ;
• Originates on our Platform but continues elsewhere ;
• Originates elsewhere but is brought to our Platform ; or
• Targets our users and is reported to us with evidence

6.4. Harassment of Creators

Subscribers must respect Creator boundaries. The following behavior is prohibited :

a) Excessive Messaging - Sending repeated messages after being ignored or asked to stop

b) Demanding Personal Contact - Pressuring for personal phone numbers, addresses, or meetings outside Platform

c) Sexual Demands - Requesting sexual content or favors

d) Threats for Attention - Threatening negative reviews, charge backs, or exposure if ignored

e) Stalking - Attempting to find Creator's personal information or location

f) Boundary Violations - Ignoring Creator's stated boundaries or rules

g) Entitlement - Demanding responses or content beyond what is offered

6.5. Harassment by Creators

Creators must treat Subscribers professionally. Following behavior is prohibited :

a) Verbal Abuse - Insulting, degrading, or belittling Subscribers

b) Exploitation - Taking advantage of Subscriber admiration or vulnerability

c) Manipulation - Emotionally manipulating Subscribers for money or favors

d) Discrimination - Treating Subscribers differently based on protected characteristics

e) Privacy Violations - Sharing Subscriber information or conversations

f) False Promises - Promising services or content with no intention to deliver

6.6. Reporting Harassment

If you experience harassment:

Block the User — Use the block feature to stop further contact

Document Everything — Take screenshots with timestamps

Report the User — Use the in-app report function or report on Designated E-mail Id with subject “Harassment Report” 

7. OTHER RESTRICTED ACTIONS

In addition to above, the Community members are prohibited from engaging into following activities :

Illegal Activities:

• Engage in any activity that violates Indian law or international law
• Use the Platform for money laundering, terrorism financing, or other financial crimes or fraud schemes
• Distribute illegal substances or controlled materials
• Impersonate someone else or create fake accounts or engage in identity theft on or through the Platform

Commercial Violations:

• Use the Platform for unauthorized commercial purposes
• Solicit Users to transact outside the Platform
• Advertise third-party products or services without authorization
• Resell or redistribute Creator content

Intellectual Property:

• Infringe on copyrights, trademarks, or other intellectual property rights
• Upload content you do not have rights to share
• Remove watermarks, credits, or attribution from content

Platform Integrity:

• Attempt to hack, reverse engineer, or compromise the Platform
• Use bots, scrapers, or automated tools without authorization
• Create fake accounts or impersonate others
• Circumvent security measures or access controls
• Manipulate ratings, reviews, or engagement metrics

8. SAFETY GUIDELINES

Community Members are advised to follow following safety guidelines :

8.1. Online Safety

a) Protect Personal Information - Don't share your address, phone number, workplace, or financial details

b) Use Strong Passwords - Unique, complex passwords; enable two-factor authentication

c) Verify Identities - Be cautious of impersonators; verify through official channels

d) Recognize Scams - Be wary of requests for money, gifts, or personal information

e) Report Suspicious Activity - Report any suspicious accounts or behavior

8.2. Financial Safety

Do:

✅ Use only Platform payment methods to make payment for services to be availed on Platform

✅ Keep transaction records

✅ Report suspicious payment requests

✅ Verify all charges on your statements

✅ Use secure internet for transactions

Don’t:

❌ Share bank account details in chat

❌ Send money outside the Platform

❌ Accept requests for gift cards or crypto

❌ Click suspicious payment links

❌ Share OTPs or passwords with anyone

8.3. Mental Health and Well-being

We care about the mental health of our Community Members. Following is advised for mental health and well being of all Users

- Take breaks from the Platform when needed

- Set boundaries for your online interactions

- Don't engage with content that distresses you

- Reach out for help if you're struggling

- Be mindful of the impact of your content on others

- Report content that promotes self-harm or suicide

8.4. Emergency Situations

If you encounter an emergency during any Platform interaction:

Medical emergency - Call 108 (Ambulance)

Cyber crime Report - https://cybercrime.gov.in

Child in danger - Call 1098 (Childline)

Report to Company: After ensuring safety, report to Designated E-mail ID with subject "URGENT: Safety Emergency"

9. REPORTING VIOLATIONS

9.1.If you encounter content or behavior that violates these Guidelines, you may report as under :

In-App Report - Tap the three dots (⋮) on content → Select "Report" → Choose reason

Profile Report - Go to user profile → Tap "Report" → Provide details

Email Report - Email on the Designated E-mail ID with subject "Violation Report"

Emergency Report - Email on the Designated E-mail ID with subject "URGENT: [Type of Emergency]"

9.2.What to Include in a Report

a) Your Account Details - Username, registered email

b) Violator's Account - Username or profile link

c) Type of Violation - Category of violation

d) Description - Detailed description of what happened, including web-path to the violating content, if possible.

e) Evidence-Screenshots, links, timestamps

f) Date/Time-When the violation occurred

g) Witnesses-Other users who witnessed (if applicable)

h) Declaration

“I, [Your Full Name], son/daughter/wife of [Father's/Husband's Name], residing at [Your Full Address], do hereby solemnly affirm and declare that the information provided in this application and the accompanying documents is true, correct, and complete to the best of my knowledge and belief.

I fully understand that if any information given by me is found to be false, misleading, or incorrect, I shall be liable for criminal prosecution under the applicable provisions of the Bharatiya Nyaya Sanhita (BNS) and other relevant laws, and my application/registration shall be liable to be canceled or terminated summarily.”

9.3.  Anonymous Reporting

• You may also report anonymously through the in-app report feature
• Anonymous reporters cannot receive follow-up or outcome notification
• Your identity is protected from the reported user

9.4. The User will receive an acknowledgement of the Report within 24 hours.

9.5. In addition to User Report, the Company also uses a combination of methods to enforce Community Guidelines, including :

Automated Systems: AI-powered detection of prohibited content

Human Review: Manual review of flagged content by trained moderators

Creator Self-Moderation - Creators moderating their own content and interactions

9.6. Pending the investigation, Company shall be entitled to take down or suspend the violating content. Post investigation or review, if the Company is of a view that a violation has occurred, it shall be entitled to take one or more of following actions with resect to violator / violating content, depending upon severity of violation, intent, past record of violator, impact, context and policy of the Company in this regard :

a) Warning - Notification of violation with education / training sessions on Policy compliances

b) Content Removal - Removal of violating content

c) Feature Restriction - Temporary restriction of specific features (messaging, posting, etc.)

d) Temporary Suspension - Account suspended for 7-30 days

e)  Penalty – Penalty can be charged by Company upon Creator

f)  Permanent Ban - Account permanently terminated

g) Earnings Forfeiture - Creator earnings withheld for serious violations

h) Legal Action –Report to law enforcement; civil or criminal proceedings

9.7. In addition to above, following additional actions may be taken by Platform in case of violator being a creator :

a) Removal from discovery, reduced visibility

b) Mandatory refunds,

c) Increased platform fee share

d) Earnings hold, payout suspension

e)  Permanent ban, forfeiture of pending earnings

9.8. In case it turns out that the Report is False, and is not due to a bona-fide mistake or mis-understanding, the Company shall be entitled to take action against the person reporting by way of feature restriction, account suspension or termination, or proceed against the same as harassment in appropriate cases, in terms of this Policy.

10. APPEAL

10.1. If your content is removed or your account is actioned, you may appeal the decision by sending e-mail to designated e-mail ID, with  Subject Line "Appeal: [Action Type] - [Username]".

10.2. Contents of Appeal

a) Your username and registered email

b) Date of enforcement action

c) Type of action taken (warning, suspension, ban, etc.)

d)  Content or behavior that was actioned

e)  Why you believe the decision was incorrect

f) Any supporting evidence or context

10.3. Possible Appeal Outcomes

Appeal Upheld - Original decision overturned; content restored / account reinstated

Appeal Partially Upheld - Decision modified (e.g., reduced suspension period)

Appeal Denied - Original decision stands; reasons provided

10.4. Appeal Limitations

a) One Appeal Per Action - Only one appeal allowed per enforcement action

b)  No Appeal for Severe Violations - Permanent bans for CSAM, terrorism, or criminal activity are generally not appealable

c) Timeline Strict - Appeals submitted after 30 days of action may not be reviewed

d) Final Decision - Appeal decision is final; no further appeals

11.SPECIAL PROVISIONS

11.1. SYNTHETICALLY GENERATED INFORMATION

(a)  ‘synthetically generated information’ or ‘SGI’ means audio, visual or audio-visual information which is artificially or algorithmically created, generated, modified or altered using a computer resource, in a manner that such information appears to be real, authentic or true and depicts or portrays any individual or event in a manner that is, or is likely to be perceived as indistinguishable from a natural person or real-world event;

Provided that the purposes of this clause, an audio, visual or audio-visual information shall not be deemed to be ‘synthetically generated information’, where such audio, visual or audio-visual information arises from :

(i) routine or good-faith editing, formatting, enhancement, technical correction, colour adjustment, noise reduction, transcription, or compression that does not materially alter, distort, or misrepresent the substance, context, or meaning of the underlying audio, visual or audio-visual information; or

(ii) the routine or good-faith creation, preparation, formatting, presentation or design of documents, presentations, portable document format (PDF) files, educational or training materials, research outputs, including the use of illustrative, hypothetical, draft, template-based or conceptual content, where such creation or presentation does not result in the creation or generation of any false document or false electronic record; or

(iii) the use of computer resources solely for improving accessibility, clarity, quality, translation, description, searchability, or discoverability, without generating, altering, or manipulating any material part of the underlying audio, visual or audio-visual information;

(b)  Creator uploading such SGI on the Platform shall be responsible to ensure that such SGI :

(i)    does not violates any law for the time being in force, including the IT Act, IPC/ BNS , POCSO , Explosive Substances Act, 1908 (6 of 1908) ; or

(ii)   does not contains child sexual exploitative and abuse material, non-consensual intimate imagery content, or is obscene, pornographic, paedophilic, invasive of another person’s privacy, including bodily privacy, vulgar, indecent or sexually explicit; or

(iii)  does not results in the creation, generation, modification or alteration of any false document or false electronic record; or

(iv) does not relates to the preparation, development or procurement of explosive material, arms or ammunition; or

(v)  does not falsely depicts or portrays a natural person or real-world event by misrepresenting, in a manner that is likely to deceive, such person’s identity, voice, conduct, action, statement, or such event as having occurred, with or without the involvement of natural person ; or

(vi) does not violates any other provision of these Community Guidelines ;

(c)  Where by compliant SGI is shared by any User on the Platform, it shall ensure that such SGI shall be prominently labelled in a manner that ensures prominent visibility in the visual display that is easily noticeable and adequately perceivable, or, in the case of audio content, through a prominently prefixed audio disclosure, that can be used to immediately identify that such information is synthetically generated information which has been created, generated, modified or altered using a computer resource and such information shall be embedded with a permanent metadata or other appropriate technical provenance mechanisms, to the extent technically feasible, including a unique identifier, to identify the computer resource used to create, generate, modify or alter such information;

(d)  Sharing of any SGI, in violation of any of the above provisions may attract penalty or punishment as may be applicable under any law for the time being in force, including IPC/BNS, POCSO. Any such contravention may lead to

-immediate disabling of access to or removal of such information ;

-suspension or termination of the user account

-identification of such user and disclosure of the identity of the violating user to the complainant, where such complainant is a victim of, or an individual acting on behalf of a victim of, such contravention ;

- where such violation relates to the commission of an offence under any law for the time being in force, which requires such offence to be mandatorily reported, reporting of such offence to the appropriate authority in accordance with the provisions of the applicable law

11.3Contest and Giveaway Guidelines

If Creators conduct contests or giveaways, it shall be responsible to ensure the following :

a) Legality - Must comply with Indian prize competition laws

b) Transparency - Clear rules, eligibility, and selection criteria

c)  No Purchase Necessary - Cannot require purchase to enter (unless legally structured)

d)  Prize Delivery - Must deliver promised prizes

e)  Disclaimers - Clearly state Company is not a sponsor

f)  Tax Compliance-Must ensure necessary tax compliances and make necessary declarations in this regard

13.MISCELLANEOUS

These Guidelines are drafted in English. In case of any discrepancy between the English version and any translation, the English version shall prevail. The Guidelines shall be read and construed along with other Platform Policies. The general provisions of Terms of Use, including definitions, Modifications, Dispute resolution, confidentiality, assignment, waiver, relationship, Force-Majure, survival, indemnification, limitation of liability, platform availability etc. shall apply mutatis-mutandis to Guidelines also, unless specifically provided in these Guidelines to the Contrary.

6. You understand that these Guidelines may be updated from time to time
7. You acknowledge your responsibility for all content you post and actions you take on the Platform
